The Failure of the 28-Article Peace Proposal for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the tension caused by the presentation of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been defused. A Washington representative spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its response: a renewed assault of missile and drone strikes on Kyiv.

The Rhythm of Diplomacy and Destruction

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, negotiation efforts are conducted: optimistic declarations are released from various governments. Significant resources is expended on managing specific proposals. By night, Moscow clearly shows the world that, for them, war remains the key method for achieving "resolution".

After-Dark Attacks

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's exposure was exposed. Ukraine is equipped to monitor projectile deployments from enemy soil, a ability provided through current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to counter approaching guided weapons roared overhead – modern combat jets supplied to Ukraine by European allies.

Moments later, Kyiv's air-defence systems activated: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by Western nations. Every launch shakes the surroundings, shaking the windows. The moment of terror quickly gives way to grim resignation: maybe the hostile projectile won't strike its target this time, sparing the city from devastation and further power outages.

Persistent Threats

Soon after, a heavy machine gun engaged a aerial vehicle in the vicinity, part of a defensive team – probably allied-provided weaponry. Sadly, the bullets missed the opposing UAV – it maintained course toward its destination.

With pauses, this continued until dawn. Kyiv awoke to the daybreak reports: multiple fatalities, devastation and utility failures in many homes as a result of the nocturnal offensive. As typically, everyone still maintained normal activities – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a dependence that regional partners are evidently unprepared to fill in the immediate future.

Failed Diplomacy

The comprehensive proposal from Washington provoked deep reactions, discussion and profound anxiety – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after previous diplomatic encounters and bilateral conferences.

Every new initiative from Washington unfolds according to the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, effectively counters. They stabilise the situation but never actually win the battle. This trend will, undoubtedly, endure.

Political Considerations

It is convenient to criticize particular leaders of repeatedly advocating Russian terms. But that does not seem to be the complete picture. US administration works based on a principle well known to seasoned negotiators: you cannot secure via talks what you have lost on the battlefield. The US administration assumes that it is unrealistic to pressure the Kremlin to surrender the territory that it currently occupies in Ukraine's occupied territories.

The problem is that while acknowledging this situation, US leadership does nothing to deter Moscow, through statements or actions, from thinking that the situation will not shift further in its advantage in the months ahead.

Conflicting Perspectives

Therefore, Russian leadership is confident that the clock favors them – that Ukraine and its supporters are approaching exhaustion. Their motivation to accept conditions that does not give them the maximum possible gain is virtually nonexistent. There may be many attempts to stop fighting, but they will persist as long as Russia's leader remains completely certain in the conclusion.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing civilians and areas but averting a total frontline collapse until circumstances change in its advantage.

Existing Situation

Factually, there are no real preconditions for a ceasefire. Now, individual motivations are coming into play: leadership ambitions to negotiate peace and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the country's interests against any initiative Kyiv finds unworkable, so that their attention does not shift toward domestic problems. And although their mission will now be significantly challenging after latest incidents, it remains quite doubtful that this will change their overall approach.

These conflicting dynamics are guiding negotiations.

Summary and Prospects

It took a just a single week to kill the 28 points of the most recent proposal. Aggressive and erratic handling of the matter by American leadership, opposition by Ukraine and the remaining European nations, along with calming attempts of negotiators, and finally, latest revelations, all did their job.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are founded on Moscow's terms and demonstrate particular unwillingness to modify developments, if they remain united and improve their protective measures at a considerably quicker tempo. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to defend against evening bombardments will, for the predictable period, mainly require continued Western support.
